Terms of Service

You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is higher) to use the Services. You represent and warrant that: (a) you have full legal capacity to enter into these Terms; (b) you are not located in, or a resident or citizen of, a jurisdiction subject to comprehensive U.S. sanctions (currently including Cuba, Iran, North Korea, Syria, and the Crimea, so-called Donetsk People’s Republic, and Luhansk People’s Republic regions), and you are not on any U.S. or international sanctions list; (c) your use of the Services complies with all applicable laws in your jurisdiction, including gaming and financial-services laws; and (d) you have not been previously suspended or removed from the Services.

Prediction markets are not available in all jurisdictions. We reserve the right to restrict or decline service at our discretion, including based on your location, IP address, or regulatory changes.

You must register an account to use most features. You agree to provide accurate, current, and complete information during registration and to keep it updated. You are responsible for safeguarding your credentials and for all activity under your account. Notify us immediately at security@flicktrade.com if you suspect unauthorized access.

You may open only one account. Multi-accounting, use of VPNs or proxies to circumvent geographic restrictions, account sharing, automated registration, and use of the Services on behalf of a third party without written authorization are prohibited and may result in account termination and forfeiture of balances.

For paid prediction mode, you consent to identity verification (KYC), sanctions screening, and ongoing monitoring. We may request documentation (government ID, proof of address, source of funds) at any time and may suspend your account if verification is incomplete or if we reasonably suspect fraud, money laundering, sanctions evasion, or other unlawful activity. We cooperate with law enforcement and regulators as required by law.

fliiick offers two modes: Free Prediction Mode (no real money; for entertainment, skill-building, and social engagement) and Paid Prediction Mode (real-money predictions routed to regulated execution partners). Only Paid Prediction Mode involves financial exposure.

In Paid Prediction Mode, your orders are routed to third-party prediction market operators (including, for example, Polymarket and Kalshi). Each operator is independently regulated and has its own terms, which will apply to the portion of your activity they handle. fliiick acts as an interface and service provider; fliiick does not itself operate a commodity exchange, derivatives clearing organization, swap execution facility, money transmitter, or gaming venue except where expressly disclosed.

Top performers in Free Prediction Mode may be eligible for promotional cash rewards (“airdrops”) at fliiick’s sole discretion, subject to eligibility and verification.

Paid balances are held by our partnered payment providers and execution venues. fliiick does not take custody of customer funds except as necessary to route transactions to execution partners. Deposits and withdrawals may be subject to processing times, minimums, maximums, and verification requirements set by those providers.

Fees. fliiick is currently free for users — we do not charge a transaction or performance fee. Execution partners (e.g. Polymarket) may charge fees at the venue level; those fees are disclosed before you confirm an order. Third-party payment, banking, and network fees may also apply. fliiick reserves the right to introduce a platform fee in the future, with prior notice and updated Terms.

Payouts. Winnings are credited to your fliiick balance upon market resolution. You may withdraw available balance subject to minimums, verification, applicable taxes, and compliance checks. Withdrawal processing typically takes 1–5 business days depending on method and venue.

Taxes. You are solely responsible for determining and paying any taxes owed on winnings. We may issue tax information reports (including U.S. Form 1099 or equivalents) where required by law.

Each market is defined by its question, resolution criteria, resolution source, and end date, which are displayed before you commit an order. Resolution is determined by the execution partner operating that market based on the stated criteria. fliiick does not unilaterally resolve markets.

In the event of an ambiguous outcome, source failure, or disputed resolution, the execution partner’s resolution and dispute procedures govern. fliiick will pass through the partner’s final determination. We are not liable for execution partner decisions, delays, or errors.

• Prediction markets involve financial risk. You may lose the entire amount you commit to any position. Past performance does not guarantee future results.
• Prices are set by supply and demand and may be volatile, illiquid, or unavailable.
• Execution partner operations, settlement infrastructure, and applicable laws may change, which can affect the availability of markets, delays in settlement, or ability to withdraw.
• AI features, including fliiick AI recommendations and trading bots, are informational only. They are not financial, investment, legal, tax, or other professional advice. You are solely responsible for your predictions.
• Do not commit money you cannot afford to lose. If you believe you have a gambling problem, contact 1-800-GAMBLER (U.S.) or your local support service, and consider using the account limits available in Settings.

You will not, and will not attempt to, use the Services to:

• Violate any law, regulation, contract, intellectual property right, or third-party right.
• Manipulate markets, including wash trading, spoofing, front-running, coordinated collusion, and trading on material non-public information.
• Interfere with the integrity or security of the Services, including by scraping, reverse-engineering, probing for vulnerabilities, or using unauthorized bots or automated systems (other than Flick-provided Trading Bots used in accordance with the Services).
• Impersonate any person or misrepresent affiliation.
• Circumvent geographic restrictions, identity verification, or account limits.
• Post, transmit, or promote content that is unlawful, defamatory, harassing, hateful, obscene, or infringing.
• Launder funds, finance terrorism, or engage in sanctions evasion.
• Resell, sublicense, or commercialize the Services without written authorization.

We may investigate and take appropriate action, including freezing balances, terminating accounts, reporting to authorities, and pursuing legal remedies.

You retain ownership of the content you post (handles, posts, comments, shared predictions). You grant fliiick a worldwide, non-exclusive, royalty-free, sublicensable license to host, reproduce, modify, adapt, publish, distribute, and display that content for the purpose of operating and promoting the Services. You represent that you have all necessary rights to grant this license.

You are solely responsible for your content. We may remove content that violates these Terms or applicable law, and we may suspend accounts that repeatedly or egregiously violate community rules.

The Services, including software, trademarks, logos, text, graphics, and other content (excluding user content), are owned by fliiick or its licensors and are protected by copyright, trademark, and other laws. Subject to these Terms, fliiick grants you a limited, revocable, non-exclusive, non-transferable license to use the Services for your personal, non-commercial use. No other rights are granted.

The Services integrate with third-party services (including execution partners, payment processors, KYC vendors, analytics, and app stores). Your use of those services is subject to their terms and privacy policies. fliiick is not responsible for third-party services and does not endorse, warrant, or guarantee them.

The Services are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage. fliiick does not warrant that the Services will be uninterrupted, error-free, accurate, secure, or free of harmful components. fliiick disclaims all liability for decisions you make based on AI outputs, market data, or content available through the Services. Some jurisdictions do not allow the disclaimer of certain warranties, in which case this disclaimer may not apply to you.

To the maximum extent permitted by law, in no event will fliiick or its affiliates, officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost data, or business interruption, arising out of or relating to the Services, even if advised of the possibility. fliiick’s total liability for any claim relating to the Services will not exceed the greater of (a) the fees you paid fliiick in the twelve months preceding the claim, or (b) one hundred U.S. dollars ($100). Some jurisdictions do not allow these limitations, in which case they may not apply to you.

Informal resolution first. Before filing a claim, you agree to contact us at legal@flicktrade.com and attempt good-faith negotiation for at least 30 days.

Binding arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or the Services that is not resolved informally will be resolved by binding arbitration administered by JAMS under its streamlined rules, seated in Wilmington, Delaware (or, for users outside the U.S., as required by applicable law). Judgment on the award may be entered in any court of competent jurisdiction.

Class-action waiver. You and fliiick agree that each may bring claims only in an individual capacity, not as a plaintiff or class member in any purported class or representative proceeding. If a court decides this waiver is unenforceable, then the arbitration agreement will not apply to the specific claim to which the waiver does not apply; all other claims will remain subject to arbitration.

Small claims and exceptions. Either party may bring an individual action in small-claims court for disputes within that court’s jurisdiction. Claims for injunctive relief based on intellectual property or unauthorized use may be brought in court.

Opt-out. You may opt out of arbitration by sending written notice to legal@flicktrade.com within 30 days of first accepting these Terms, including your name, account email, and a clear statement that you decline arbitration.

You may close your account at any time from Settings or by contacting support. We may suspend or terminate your access at any time, with or without notice, if we reasonably believe you have violated these Terms, applicable law, or for the protection of users or the Services. Upon termination, provisions that by their nature should survive (including Sections 5, 10, 12, 13, 14, and 16) will continue to apply.

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles, except that the Federal Arbitration Act governs the interpretation and enforcement of the arbitration provisions in Section 14. To the extent a matter is not subject to arbitration, the state and federal courts located in New Castle County, Delaware shall have exclusive jurisdiction.

We may update these Terms from time to time. For material changes, we will provide advance notice by email, in-app notice, or by updating the “Last updated” date. Continued use after the effective date constitutes acceptance. If you do not agree to the updated Terms, stop using the Services.

These Terms, along with our Privacy Policy and Cookies Policy, are the entire agreement between you and fliiick regarding the Services. If any provision is held unenforceable, the remaining provisions will remain in effect. Our failure to enforce any right is not a waiver. You may not assign these Terms without our consent; we may assign them freely. Notices to you may be provided via email or in-app. Notices to us must be sent to legal@flicktrade.com.
